General Terms and Conditions of Swiss Pet Solution (Swiss Pet Solution GTCs)
1. Scope
These General Terms and Conditions of Swiss Pet Solution (hereinafter ‘Swiss Pet Solution GTCs’) apply to any purchases of animal feed from Granovit SA (hereinafter ‘Granovit’) through the webshop Swiss Pet Solution. Swiss Pet Solution is a business unit of Granovit SA. GRANOVIT SA, Route des Treize Cantons 2A, 1522 Lucens.
These Swiss Pet Solution GTCs are deemed to have been accepted upon any order by a purchaser (hereinafter the ‘Purchaser’, with Granovit collectively the ‘Parties’). Any general terms and conditions of the Purchaser are excluded. Any agreements on the Swiss Pet Solution GTCs are only effective when they are agreed in writing by both Parties.
2. Offer/order
Orders in the webshop are binding for the Purchaser. Once the order is sent, Granovit will confirm receipt of the order immediately by email. The purchase contract is concluded upon receipt of the order confirmation.
The prices include the value added tax required by law and any other statutory charges. Shipping costs are itemised separately (see item 3 below).
Granovit reserves the right to make price changes and errors.
3. Shipping
Delivery dates and times are non-binding. Where Granovit specifies delivery times in its webshop, these are estimates and as such are non-binding.
Granovit will only send its products to delivery addresses within Switzerland.
The shipping cost is CHF 10.00 per package. Orders with a value of CHF 50.00 or more are shipped free of charge.
4. Payment
Payment may be made by credit card (Visa, Master), Twint, PayPal or invoice.
If the customer does not fulfil his payment obligations in due time, he will be immediately in default and have to pay to Granovit the statutory default interest of 5%.
5. Transfer of risk
The transfer of risk passes to the commissioned transport company upon transfer of the goods.
6. Retention of title
The title to all goods delivered by Granovit to the Purchaser is only transferred to same upon payment in full. Until the agreed remuneration has been paid in full, Granovit is entitled, at the Purchaser’s expense, to register the right of ownership to any goods that are owned by Granovit but are in the possession of the Purchaser.
7. Warranty
Granovit warrants that the animal feed it produces in-house meets all statutory requirements. The warranty regulations of respective third-party manufacturers apply to third-party products.
8. Storage conditions
Swiss Pet Solution recommendation for appropriate storage. We define the term “appropriate storage” by dark (UV protected), dry and ambient temperature (15-25°C) 1. Temperature fluctuations must NOT exceed 10°C. This is to avoid condensation humidity. 2. To guarantee the good shape of kibbles, below 0° C temperatures must be avoided. No freezing temperature. 3. The feeds must be kept in close bags, not directly on the floor (only on pallets or racks), with no direct contact to walls. Air relative humidity must be between 45-65%. 4. All plastic films or cardboard pallet protections must be immediately released after reception of the delivered feed.
9. Complaints/notices of defect
In the event of a sale by Granovit, the Purchaser must immediately check the quality and condition of the goods upon delivery and, should defects be found, notify Granovit immediately. Should the Purchaser fail to do so, the goods purchased and delivered are deemed to have been accepted, provided there are no defects that were not recognisable as such despite careful examination (‘hidden defects’). Hidden defects must be reported to Granovit in writing within two business days of their discovery. Defect rights expire 30 business days after delivery of the goods by Granovit.
10. Liability
Granovit is only liable for direct damage to the goods caused deliberately or through gross negligence. Liability for slight negligence is excluded. Granovit is not liable for damage that has not occurred to the goods; in particular, Granovit is not liable for any indirect or consequential damage resulting from the defective goods. Liability for Granovit’s auxiliary persons is excluded to the extent permitted by law.
11. Data protection
The provisions of Granovit's Privacy Policy apply.
12.Conditions of participation contests
Any natural person who has reached the age of 18 is eligible to participate in GRANOVIT SA contests. Employees of GRANOVIT SA and its authorized companies are excluded from participation. Only one participation per person is possible. GRANOVIT SA reserves the right to delete abusive entries. Winners will be notified by e-mail or social media and may be published. Participants in contests agree that submitted images or texts may be published by GRANOVIT SA and its partners. Correspondence may be entered into about the competition. Cash payment and legal action are excluded. The required information entered by the participant must be complete and truthful. Participation is free of charge and free of any obligation to purchase. The participant agrees to the evaluation of his/her data by GRANOVIT SA for marketing purposes. In particular, Granovit SA may use your data for the delivery of newsletters or other communications by e-mail or post. You may revoke the use of your data for marketing purposes at any time. Swiss law is exclusively applicable.
13. Transfer of rights and responsibilities
Granovit is entitled to transfer individual rights and obligations arising from the contractual relationship to a third party without the consent of the Purchaser.
14. Applicable law/jurisdiction
The contract between Granovit and the Purchaser is subject to Swiss law, excluding international private law/conflict of laws and the United Nations Convention on Contracts for the International Sale of Goods (CISG).
Disagreements are to be settled amicably by the Parties where possible.
The place of jurisdiction is the location of Granovit’s head office.
15. Precedence of German version
These GTCs have been drawn up in German, French and English. Where differences arise, the German text is authoritative.
